There are many points to be kept in mind before filing any divorce case in court. Divorce lawyers must be smart enough to handle various sensitive cases, like children’s guardianship, alimony, division of money and property, and many more points. It is wise to do serious market research to find Houston’s best-rated divorce lawyer, who can represent you and your case with strength and conviction. Always delve into his past records and look at his success rate, to get a clear picture of his ability.

Divorce attorneys in Houston are usually helpful no matter how amicably the marriage ends, and they are particularly advantageous when parties consider the following:

o Division of Property and Assets: An attorney is able to draw up legal documents that will fairly and clearly divide up the property and assets that were purchased or earned during the marriage. Regardless if you and your former spouse believe you can divide these assets without legal assistance, you need to protect everyone involved by creating documents recognized by the Court.

o Establishing Custody Rights and Visitation: If you have children, it is imperative that both parties establish who will have primary custody of the kids. While it may be easy to assume that both parents will want to do what is best for their children, sometimes it is hard to agree on what exactly is “the best thing”. Your family law attorney will work with both parties to make sure that everyone’s legal rights are met and that parents get the visitation time they deserve-even if they are not the primary custodial parent.

o Legal establishment of child support and any alimony/palimony: Whether or not both individuals have professions that allow them to earn a living after the divorce, attorneys in Houston will likely look into the legal aspects of alimony or palimony. This often occurs when one spouse has sacrificed personally or professionally in order for the other partner to further his or her own career, reducing the ability for the recipient to earn an income that is as high as it would have been otherwise. Not every divorce will require this type of payment, but divorcing spouses should not assume that they are not eligible for this reimbursement without speaking with an attorney.

As a general practice Houston law firm, Sondra Kaighen & Associates, P.C. serves clients with diverse needs throughout Houston and the Texas Gulf Coast area. Their attorneys cover a range of legal issues pertaining to family law and criminal law. Sondra Kaighen, the firm’s principle, has over twenty years of experience in family law and is a certified specialist in the field by the Texas Board of Legal Specialization.

Their Houston general legal practice law firm represents clients from all over the United States and abroad. They foster open communication with clients and encourage them to ask questions and voice their concerns. Their lawyers understand that family law cases are often stressful and can be draining emotionally, physically, and economically. That is why their Houston Law Firm committed to finding a smooth and satisfactory resolution to your legal issue as quickly as possible.
Finding the right family law attorney (or divorce lawyer) is a process that many people are not entirely comfortable with. People often don’t know what qualifications to look for. Often the only information people have to go on is a recommendation from a friend, or listings in a phone book. But retaining legal representation for your divorce is a process that warrants some extra due diligence on your part. Here are some tips to help you find the best divorce attorney for you:

Create a list: You could open the phone book to ‘divorce lawyers’ and just point to see which you see first. But there is a better way. If you feel comfortable asking friends to recommend a divorce lawyer that may be a good place to start. You can also check one of several reputable family law yellow pages on the internet. Those directories will help you find qualified divorce lawyers in your area. Make sure you only consider family law attorneys who practice in the county where you live. The details of family law can vary significantly from one county to another.

Narrow the list: Look for lawyers who have devoted their entire practice to the area of family law. Several states offer certifications in family law legal specialization. Ensure that the divorce attorneys on your list are in good standing with your state bar. Also, while there is no single label that universally identifies good divorce lawyers, a generally respected lebel is the Martindale Hubbell peer review rating. Attorneys only qualify for this rating after they have been admitted to the bar for five years or more.

Meet face-to-face: Be aware of the responsiveness of each firm or attorney to your meeting request. You want to be sure that the family law attorney you retain is able to devote an adequate amount of time to your case; if it takes 3 business days or more to get a call back it may be an indication that they are too busy to give your case the attention it deserves. When you do meet with your short-list candidates, ask about their experience with cases like yours. Realize that the attorney you interview may not be the one who is actually assigned to your case. Ask which associate will be working on your case, and meet that individual as well. He or she will likely be your day-to-day point of contact and it is important that you feel comfortable working with him/her.

If it’s worth hiring a divorce lawyer for your case, it’s worth this extra homework up front. Take the time to create a qualified list of candidates and have a better chance of finding the best divorce attorney for you.

If you’ve ever considered buying a home instead of renting, the Homebuyer Tax Credit does give you incentive. Right now, real estate is a buyer’s market, with housing prices lower than they’ve been in years. Add on top of that the whopping $8000 tax credit you’ll get with this new tax law under the new president, and the deal is considerably sweetened. You can even claim the credit on your 2008 taxes.

<!--
google_ad_client = "pub-1420798661618895";

If you signed the papers on a first time home purchase on December 31, 2008 or before, however, you won’t be getting that $8000 credit. Also, if you make more than $75,000 (or more than $150,000 for a couple) annually then the $8000 credit is lessened, and you won’t be able to get it at all if you make over $95,000 (or $170,000 for a couple) in a year.
Don’t rush into a decision to get the tax credit. A restriction in the law requires that you keep the home for a minimum of three years. Break that rule, and you could have to pay back the $8000.

Have a job? You’ll probably be able to get the $400 tax credit ($800 for a married couple) called the Making Work Pay provision. Most people with income, even self-employment income, will be able to claim that from one of the tax laws under the new president in 2009 and 2010. The income caps for the $8000 first time homebuyer credit applies to this one, too.

Employers may just take less tax from your paycheck to provide you this credit, so if you’re married or you have more than one job, watch your taxes carefully to make sure you’re not paying too little, or you could end up with a huge bill and penalties at tax time in 2009.

A new tax law under the new president also accounts for a $250 payment to those who get Social Security as well as Social Security disability payments, government pensioners, and veterans. It’ll arrive over the summer automatically for all but government retirees, who must file in 2010.

College students can deduct some of their college bill in the coming year, car buyers can deduct the sales tax paid on the purchase, and you can even claim deductions on certain “green” and environmentally friendly purchases thanks to some tax laws under the new president.

If you live in South Carolina and you are going through a divorce you need to hire an experienced divorce attorney because you will need legal advice. Hiring an experienced and dedicated attorney is the best option if you are looking at paying alimony, fighting for child custody, and much more. There are five grounds for divorce in this state, as well as jurisdictional and venue requirements.

When you are going through a divorce you may have problems with mediation and agreeing to certain things in the divorce like the amount of money you have to pay or should receive for alimony and child support. You might feel you deserve custody also. Mediation is when you will sit with a court appointed professional staff that will try and make the both of you come to agreements about the divorce. Mediation is required in many South Carolina counties in divorce, child custody cases, alimony and property division, as well and other states around the nation. An attorney can help you work through agreements and possibly bypass the mediation process in the courts. Alternately if you hire an attorney who also a certified mediator, you get the benefits of both legal advise and/or mediation services, depending on your needs.

Hiring a family law attorney can help you come to agreements with your spouse during the divorce process. You do not want to fight and be bitter through the process because it can cause you to lose rights. However, if one of the parties is impossible to work with then the judge may recognize this. An attorney can help make the process more fair when it comes to alimony payments and if you even have to pay anything, child support and visitation and more.

Consulting with an experienced attorney when you are going through a divorce, legal separation, child custody, child support, adoption, alimony or property division in South Carolina is the best option you can chose. Finding an experienced and dedicated attorney will help you ensure the outcome is fair and at the best interest of the child. An attorney can help you calculate alimony payments if you should have to pay them, get the most time in visitation or even full custody, and help with mediation. You need a professional staff to work with you through the entire process. It can even help to speed up the entire process by coming to agreements with the other party.

These are things such as the home, vehicles, and bank account funds. By being married both parties agree to share financial gains and losses. Marital assets can be divided in two ways depending upon the standards of family law set in each state. Approximately ten states follow community property laws while the others use equitable distribution. Knowing the particular states laws can be very helpful in being prepared for the divorce and proceedings. Divorce lawyers can help determine which assets will be included as marital assets and most reasonable way to divide them.

Equitable distribution is the more common of the two ways to divide assets. Distribution of assets is not necessarily guaranteed to be 50/50 in these states. The court itself decides what division percentage is fair and reasonable for both parties. A court makes this decision based on many different factors. Some of them include the length of the marriage, both parties’ income, responsibility for the children, and debt. Another factor is what each person had when they entered the marriage. A prenuptial agreement takes precedence over the laws definition of distribution and can make determining the marital assets much easier.

Remember these things when it comes to equitable distribution. Everything bought during the marriage will be divided. Who bought it or whose name is on the item does not matter. It is the responsibility of the divorcing couple to prove which assets are marital assets. This includes proving a spouse got rid of certain assets knowing divorce was inevitable. Having knowledge of the state laws can make it easier to work with divorce lawyers in getting desired items or compensation. Finally, each party is also responsible for debt accrued during the marriage.

Community property results in a 50/50 distribution of all marital assets. All debts are also marital property and will be equally split between both parties. Spouses who know their state follows community property laws may hide debt or increase it as a way to get even. When a home is owned in more than one state, it may be possible to file for divorce in either state. Consult with someone familiar with family law to determine which state’s laws will be most beneficial when filing for the divorce. People with higher incomes benefit more from equitable distributions states whereas someone who has no or very little income would benefit more by community property laws.

Many families going through a divorce turn to a child custody lawyer , or a team of, to solve their custody cases. With a now unbalanced household, parents often do not know what the best thing for their child really is. They may receive advice from former couples who have gone through divorce, or from people with no real experience on the subject. Their own parents may be handing out advice as well, with no real knowledge or insight into the issue. Whatever a family’s situation, having a child custody lawyer to help them get through the ordeal will be a wise decision.

Lawyers have often been given a bad rap when it comes to handling divorce cases or child custody cases. However, most lawyers have their client’s best interest in mind and do not want to see an ugly fight over a child, or children, any more than the parents do. Reaching a fair, balanced settlement should always be the top priority of the parents as they decide on the custody of their children. A child custody lawyer will bring experience to the table and with an expertise in handling these types of cases, will be able to maintain a level-headed environment where civil discussion persists and a just decision can be reached.

No matter how much parents want their children to live with them, they must realize that doing what is best for their children should be their top priority. Many cases end in bitter rivalry among parents, which hurts their children more than they may realize. A quick and timely settlement will put less strain on an already strained relationship between the now ex-husband and ex-wife and will be much easier on the children. The quicker the decision and the less animosity among their parents, the more natural the transition to their different surroundings or circumstances will seem. A child custody lawyer can do whatever is possible to ensure that this outcome is given a top priority as the former couple discusses their custody agreement.

Unfortunately, divorce often ends in the bitter rivalry described earlier. While the parents are surely not happy with the situation, as nobody likes to live their life angry or bitter, the children are the ones who almost always suffer the most. Seeing their parents argue is an unpleasant circumstance for a young child to be put in. Picking sides and witnessing their parents’ animosity towards one another is something no child should be put through. Going to a child custody lawyer to help solve a divorced couple’s custody agreement is a good move, as it will help end any disputes and reach a reasonable and balanced agreement.

Before you find a divorce lawyer to handle your divorce, you need to know what you want out of the proceedings. Let’s face it, divorce is not only about getting out of a relationship, it is also about getting your fair share of the assets that you and your spouse have accumulated over the years. No, you are not being greedy if you try to get your fair share of your conjugal assets. Unless you and your spouse signed an iron clad prenuptial agreement before you said “I do” in front of the magistrate, you are entitled to half of the assets that you and your spouse have accumulated during your marriage. Unfortunately, your fair share will not be handed to you on a silver platter so you need to find a divorce lawyer who can help you get it.

Another thing that you will need to fight for during a divorce is child custody and support. If you want to get custody of the children, you will need to find a good divorce lawyer to do all the work for you. Now, things can get especially complicated if one or both of you are actively serving the military, so you may want to consider hiring a military divorce lawyer in this case.

Remember that most lawyers are not cheap and if you are on a tight budget, you may end up getting buried in a pile of debts just to pay off your lawyer’s professional fees. To make sure that you do not spend more money than you should on attorney’s fees, make sure that you set a budget for your divorce proceedings and stick to it. You should also negotiate your lawyer’s fees. Most lawyers are willing to collect a percentage of the settlement at the end of the litigation instead of asking for outright payments for his or her services.

So if you are not happy with your marriage and want a divorce, the Lybarger Law Firm is always at your service. It is dedicated to providing high quality legal representation in family law matters.
There are many reasons to call an attorney. Adoptions, divorces and domestic violence are just some of the areas of family law that will require the help of a professional to ensure the process goes smoothly. But how does one make the decision about which attorney to call?

The first, you should find a family law attorney who only take up cases relating to all kinds of family related issues. These can be adoption, prenuptial agreements, marriage, domestic violence, divorce, separation, legal separation, annulment, division of the property accumulated during the marriage, alimony, negotiation, adjudication, child custody and support, child abduction, kidnapping or child seizure, emancipation, abuse in the marriage, parental rights, paternity, juvenile, felonies etc., and many such cases related to family. Because an attorney works solely in family law will ensure that the professional chosen is well versed in all aspects of family law, from divorce to adoption and everything in between. This is the type of attorney that will provide the greatest expertise in these areas.

Attorneys who practicing family law are the best with more experience than qualifications. It is amazing how much documentation and negotiation is expected when taking care of a family related case. Along with this the lawyers must be able to support the party professionally, emotionally and morally all the while helping in separating the client from the spouse and in some instances from the children.

While one should never select a family law attorney based solely on price, it is important to know how much the legal services will cost. Prospective clients should ask about the hourly rate for the attorney, and find out if other staff members will charge for their services separately. It is also a good idea to find out if other professionals will be utilized in the process, such as psychologists or private investigators, since these services do not come cheap. By asking the right questions, it is possible to get a rough idea of the cost of legal services before hiring a specific lawyer.

It is also important to inquire about strategy and predictions for the specific case. It is perfectly legitimate to find out what sort of strategy a family law attorney would employ to win the case. It is also appropriate to ask what the odds are of winning the case, according to this same attorney. If the answers don’t inspire comfort and confidence, there is no reason why another attorney can’t be consulted for the sake of comparison.

Finding the right family law attorney will make all the difference, no matter what type of case is involved. By scheduling an initial consultation and asking plenty of questions at this meeting, it will be much easier to find the attorney that is the right fit.
